Welcome to Southern Sisters Cafe ("we," "us," or "our"), located at 2242 Sarno Road, Melbourne, Florida. By using our website, subscribing to our email newsletter or SMS marketing programs, or placing food orders with us over the phone, you ("Customer," "User," or "you") agree to be bound by these Terms and Conditions.

1. Phone Ordering & Pricing Estimates

Southern Sisters Cafe operates as a traditional call-in and dine-in restaurant.

• Order Placement: All takeout and pickup orders are placed verbally by calling us at (321) 775-3442.
• Verbal Quotes are Estimates Only: Any total price or cost breakdown provided by our staff over the telephone is a good-faith estimate only.
• Final Pricing: The final binding price of your order—including all applicable manual item calculations and Florida state sales taxes—will be calculated by our point-of-sale register and finalized in person at the time of pickup.
• No Extra Hidden Fees: We do not charge hidden fees, packaging fees, credit card surcharges, or mandatory service fees. Tipping our staff is entirely optional.

2. No-Show & Abandoned Food Policy

Because we cook your food fresh to order, a phone order constitutes a verbal agreement to purchase at the final price established at the register.

If you place a phone order for pickup and fail to collect it within one (1) hour of the agreed pickup time, the food will be disposed of for safety reasons.

We reserve the right to require in-person or up-front payment at the register before taking future phone orders from any customer who repeatedly fails to pick up their called-in orders.

3. Digital Marketing Programs (Email & SMS Opt-In)

We love keeping our local regulars updated with news and specials through our email newsletter and text club.

• Voluntary Sign-Up: Joining our email or text lists is entirely voluntary and is never required to dine with us or place a phone order.
• Carrier Rates: While we never charge you to receive our updates, standard message and data rates may apply depending on your mobile carrier.

4. MANDATORY DISPUTE RESOLUTION & CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT PROTECTS OUR SMALL BUSINESS FROM PREDATORY LITIGATION.

A. Binding Individual Arbitration

You and Southern Sisters Cafe agree that any legal dispute, claim, or controversy arising out of or relating to your phone orders, text messages, email communications, or physical visits to our cafe shall be resolved exclusively through binding individual arbitration in Brevard County, Florida.

B. Written Notice Safe Harbor

Before initiating any formal legal or arbitration claim (particularly regarding marketing text messages or emails), you agree to notify us in writing at info@southernsisterscafe.com detailing your phone number and the nature of the issue. You agree to grant Southern Sisters Cafe a 15-business-day window to investigate and manually fix any system or communication error before taking further legal action.

C. CLASS ACTION WAIVER

YOU AND SOUTHERN SISTERS CAFE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
